1. General Acknowledgement

  1. I have carefully gone through the Website ‘www.omigavip.com’ and agree to abide by the stipulations delineated in it.
  2. As a promoter in the direct selling Firm OMIGA VIP LLP, I will function strictly in accordance with the GST guidelines of the Central and State Governments.
  3. As a promoter I shall not promote anything other than the plan and project of OMIGA VIP LLP.

2. Gold Purity & Diamond Measurement

  • I understand that 22 carat gold means 91.6%, 18 carat means 75.0% and 9 carat gold means 37.5% of gold purity.
  • I understand that a diamond of one cent is 2ML and that 0.1ct is 200ML.

3. Making Charges & Manufacturing

  • I understand that in gold jewellery manufacturing, the making charges are levied along with the value of the gold used in the jewellery and making charges vary in different types of jewellery.
  • I understand that when gold jewellery is resold, the making charges paid at the time of purchase will be deducted.

4. Income, Diamond Certification & Resale

  • I understand and agree that the commission and other income are paid from the Firm’s profit.
  • I understand that diamond jewellery is made in different carats and a certificate delineating the details of the jewellery will be furnished in the certificate issued to the buyer. I also understand that in case of resale, 30% will be the deduction from the value of the product.
  • I understand and agree that the GST bill available at the time of purchasing the products should be submitted along with the Diamond certificate.
  • I understand that in advance bookings, making payments / part payments, purchases can be effected within one year from the date of payment.

5. Responsibilities and Obligations of a Promoter (Direct Seller)

As a Promoter of the Firm OMIGA VIP LLP, I shall ensure that:

  1. the terms of the offer are clear, so as to enable the consumer to know the exact nature of what is being offered and the commitment involved in the placing of an order;
  2. the presentations and other representations used in direct selling do not contain any product description, claim, illustration, or other element which directly or by implication is likely to mislead the consumer;
  3. explanation and demonstration of the product offered are accurate and complete, in particular with regard to price and, if applicable, credit conditions, terms of payment, cooling-off periods and/or return rights, terms of guarantee, after-sales service and delivery;
  4. descriptions, claims, illustrations or other elements relating to verifiable facts are capable of substantiation;
  5. misleading, deceptive or unfair sales practices are not used;
  6. direct selling is not represented to the consumer as being a form of market research;
  7. promotional literature, advertisements or mailings contain the name and address or telephone number of the direct selling company, and include the telephone number of the direct seller;
  8. the remedial action open to the consumer is clearly set out in the order form or other accompanying literature provided with the product;
  9. offering a right of return is provided in writing;
  10. the provisions of the Legal Metrology Act, 2009 and the rules framed thereunder are complied with;
  11. appropriate steps are taken to ensure the protection of all private information, according to the laws for the time being in force, provided by a consumer;
  12. all relevant statutory laws are complied with, including payment of taxes and deductions as per Income Tax norms, GST etc.

6. A Promoter (Direct Seller) Shall Not

  1. indulge in fraudulent activities or sales and shall take reasonable steps to ensure that participants do not indulge in false or misleading representations or any other form of fraud, coercion, harassment, or unconscionable or unlawful means;
  2. engage in, or cause or permit, any conduct that is misleading or likely to mislead with regard to any material particulars relating to its direct selling business, or to the goods or services being sold by itself or by the direct seller;
  3. indulge in mis-selling of products or services to consumers;
  4. use, or cause or permit to be used, fraud, coercion, harassment, or unconscionable or unlawful means in promoting its direct selling business, or the goods or services being sold by the direct seller;
  5. charge any entry fee or subscription fee;
  6. induce consumers to make a purchase based upon the representation that they can reduce or recover the price by referring prospective customers to the direct sellers for similar purchases, if such reductions or recovery are contingent upon some uncertain, future event;
  7. visit a consumer’s premises without an identity card and prior appointment or approval;
  8. provide any literature to a prospect which has not been approved by OMIGA VIP LLP;
  9. require a prospect to purchase any literature or sales demonstration equipment;
  10. in pursuance of a sale, make any claim that is not consistent with claims authorized by the direct selling entity.
